عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «الْبَيِّنَةُ عَلَى الْمُدَّعِي وَالْيَمِينُ عَلَى الْمُدَّعَى عَلَيْهِ» . رَوَاهُ التِّرْمِذِيّ
‘Amr b. Shu'aib, on his father’s authority, told that his grandfather reported the Prophet (ﷺ) as saying, “Proof lies on the plaintiff and the oath is to be sworn by the defendant.” Tirmidhi transmitted it.

وَعَن أبي هريرةَ أنَّ رجُلينِ اختَصما فِي دَابَّة وَلَيْسَ لَهما بَيِّنَةٌ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «استهِما على اليَمينِ» . رَوَاهُ أَبُو دَاوُد وابنُ مَاجَه
Abu Huraira told that two men disputed about an animal but could produce no proof, so the Prophet (ﷺ) said, “Cast lots about the oath.” Abu Dawud and Ibn Majah transmitted it.

Ibn ‘Abbas told that the Prophet (ﷺ) said to a man whom he had asked to take an oath, “Swear by God than Whom there is no god that you have nothing belonging to him,” i.e. the plaintiff. Abu Dawud transmitted it.
