وَعَنْ جَابِرٌ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِنَّ الْعُمْرَى مِيرَاثٌ لِأَهْلِهَا» . رَوَاهُ مُسلم

Jabir reported the Prophet (ﷺ) as saying, “What is given in life-tenancy: is part of the inheritance of those who receive it.” Muslim transmitted it.

وَعَنْهُ قَالَ: إِنَّمَا الْعُمْرَى الَّتِي أَجَازَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِن يَقُول: هِيَ لعقبك فَأَمَّا إِذَا قَالَ: هِيَ لَكَ مَا عِشْتَ فَإِنَّهَا ترجع إِلَى صَاحبهَا
